Welcome to The Labora. These Terms of Service ("Terms") govern your use of our AI sales automation platform and services. By accessing or using our services, you agree to be bound by these Terms.

By creating an account, accessing, or using The Labora platform ("Service"), you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

The Labora provides an AI-powered sales automation platform that includes:

  • Lead scoring and qualification
  • CRM integration and data synchronization
  • Automated email and communication sequences
  • Analytics and reporting dashboards
  • API access for custom integrations

3. Account Registration

To use our Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payments

4.1 Pricing

Our Service is offered on a subscription basis. Current pricing is available on our website. We may change pricing with 30 days' notice.

4.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method automatically for each billing period.

4.3 Refunds

Annual subscriptions are eligible for a full refund within 14 days of purchase. Monthly subscriptions are non-refundable. Contact support@thelabora.com for refund requests.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Send spam, unsolicited emails, or violate anti-spam laws
  • Upload malicious code or attempt to breach security
  • Impersonate others or provide false information
  • Reverse engineer or attempt to extract source code
  • Resell or sublicense the Service without authorization
  • Exceed rate limits or abuse system resources
  • Violate the rights of others, including intellectual property rights

6. Data and Privacy

Your use of data through our Service is subject to our Privacy Policy. You represent that you have all necessary rights and consents to use the data you upload or process through our Service, including compliance with applicable data protection laws (GDPR, CCPA, etc.).

7. Intellectual Property

7.1 Our Property

The Service, including all software, designs, text, and content, is owned by The Labora and protected by intellectual property laws. We grant you a limited, non-exclusive license to use the Service during your subscription.

7.2 Your Content

You retain ownership of data you upload to the Service. You grant us a license to use this data solely to provide and improve the Service.

8. Third-Party Integrations

Our Service integrates with third-party platforms (CRMs, email providers, etc.). Your use of these integrations is subject to their respective terms. We are not responsible for third-party services.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. Check our status page for current availability.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS

11. Indemnification

You agree to indemnify and hold harmless The Labora and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

Either party may terminate the subscription with 30 days' notice. We may suspend or terminate your account immediately for violations of these Terms. Upon termination, your access to the Service will end, and we may delete your data after 30 days.

13. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes will be resolved in the courts of Dubai, UAE, unless otherwise required by applicable law.

15. Dispute Resolution

Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us at legal@thelabora.com. If informal resolution fails, disputes will be resolved through binding arbitration.

16. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and The Labora.
  • Severability: If any provision is found unenforceable, other provisions remain in effect.
  • Waiver: Failure to enforce any provision is not a waiver of that provision.
  • Assignment: You may not assign these Terms without our consent.
